Welcome to JambaHR ("Platform", "Service", "we", "our", "us").
These Terms of Service ("Terms") govern your access to and use of JambaHR's software platform, website, applications, and related services.
By accessing or using JambaHR, you agree to be legally bound by these Terms.
If you do not agree, you must not use the platform.
1. Definitions
"Company"
Refers to the organization/business purchasing or subscribing to JambaHR.
"Authorized Users"
Employees, HR personnel, administrators, recruiters, managers, contractors, or representatives authorized by the Company.
"Employee Data"
Includes:
- Employee personal details
- Employment records
- Salary details
- Documents
- Identification records
- Performance reviews
- Attendance data
- Recruitment information
- Uploaded files
"Services"
Refers to all software, products, applications, APIs, dashboards, and services offered by JambaHR.
2. Eligibility
You must:
- Be at least 18 years old
- Have authority to bind your organization
- Use the platform for lawful business purposes only
3. Account Registration
To use JambaHR:
- You may need to create an account
- You must provide accurate information
- You are responsible for maintaining login credentials
- You are responsible for activities under your account
You must immediately notify us of unauthorized access.
4. Subscription Plans & Billing
JambaHR may offer:
- Monthly subscriptions
- Annual subscriptions
- Enterprise plans
- Custom pricing plans
Customers agree to pay all applicable fees.
Failure to pay may result in:
- Service suspension
- Account restriction
- Termination
5. Free Trials / Demo Accounts
We may provide:
- Free trials
- Beta access
- Demo accounts
These may have:
- Limited features
- Limited storage
- No uptime guarantees
We may revoke trial access anytime.
6. Customer Responsibilities
Customers are solely responsible for:
- Accuracy of employee data
- Compliance with labor laws
- Payroll calculations
- HR policy implementation
- Managing user permissions
JambaHR provides software tools only.
We do not act as your employer, payroll provider, legal advisor, or HR consultant.
7. Acceptable Use Policy
You agree NOT to:
- Upload malicious software
- Attempt unauthorized access
- Reverse engineer the platform
- Abuse APIs
- Harass users
- Upload unlawful content
- Violate privacy laws
- Use the platform fraudulently
8. Employee Data Ownership
Your company retains ownership of all employee data uploaded to JambaHR.
We do not claim ownership.
We only process data to provide platform services.
9. Data Security
JambaHR implements reasonable security measures including:
- Encryption
- Secure cloud infrastructure
- Role-based access control
- Column-level security
- Authentication controls
- Internal access restrictions
- Logging and monitoring
We do not sell employee data.
We do not disclose employee data to unrelated third parties unless:
- Required by law
- Required for service infrastructure providers
- Authorized by customer
10. Confidentiality
Both parties agree to maintain confidentiality regarding:
- Business data
- Internal documents
- Trade secrets
- Employee records
- Proprietary information
This obligation survives termination.
11. Intellectual Property Rights
All rights related to:
- Software
- Branding
- Code
- Features
- Design
- Documentation
Remain solely owned by JambaHR.
Customers receive a limited license to use the software.
12. Third-Party Integrations
JambaHR may integrate with third-party providers such as:
- Payroll providers
- Email systems
- Cloud storage
- Communication tools
We are not responsible for third-party outages or policies.
Examples may include Google Workspace, Microsoft, or Slack Technologies integrations if enabled.
13. Platform Availability
We aim for high uptime but do not guarantee uninterrupted service.
Service may be impacted by:
- Maintenance
- Cyber incidents
- Infrastructure failures
- Third-party outages
14. Service Modifications
We may:
- Add features
- Remove features
- Modify pricing
- Improve infrastructure
We will provide reasonable notice where required.
15. Compliance With Laws
Customers must comply with:
- Employment laws
- Tax laws
- Labor laws
- Data privacy laws
For India, this may include evolving requirements under the Ministry of Electronics and Information Technology and applicable digital privacy regulations.
16. Limitation of Liability
To the maximum extent allowed by law:
JambaHR shall not be liable for:
- Indirect damages
- Lost profits
- Data loss
- Business interruption
- Employment disputes
- Payroll disputes
Our total liability shall not exceed fees paid in the previous 12 months.
17. Indemnification
Customers agree to indemnify JambaHR against claims arising from:
- Illegal use
- Labor violations
- Incorrect payroll processing
- Unauthorized employee data collection
- Breach of customer obligations
18. Termination by Customer
Customers may terminate subscription by:
- Cancelling renewal
- Providing required notice
- Paying outstanding dues
19. Termination by JambaHR
We may suspend or terminate accounts for:
- Non-payment
- Illegal activity
- Security threats
- Abuse of platform
20. Data Retention After Termination
After termination:
- Data may remain available for a limited export period
- Data may be deleted after retention timelines expire
Customers should export records before termination.
21. Backup & Disaster Recovery
While we maintain backups, customers are encouraged to maintain copies of critical records.
We are not liable for catastrophic events beyond reasonable control.
22. Beta Features
Beta features are provided:
- As-is
- Without guarantees
- Subject to change/removal
23. Governing Law
These Terms shall be governed by the laws of India.
24. Dispute Resolution
Any disputes shall first attempt informal resolution.
If unresolved:
Disputes may be resolved through arbitration under the Indian Council of Arbitration framework or applicable arbitration law.

25. Force Majeure
We are not liable for delays caused by:
- Natural disasters
- Government actions
- Internet outages
- War
- Cyber attacks
- Infrastructure failures
26. Changes to Terms
We may update these Terms periodically.
Continued use means acceptance of updated Terms.
27. Entire Agreement
These Terms, Privacy Policy, and service agreements constitute the full agreement between parties.
